Welcome to Elimu Fiti School Management System, a cloud-based educational management platform developed to assist schools in managing academic and administrative activities.

The platform provides tools for examination management, student registration, report generation, fee management, attendance, inventory, payroll, communication, timetabling, and other educational services.

These Terms and Conditions govern your access to and use of Elimu Fiti, including all associated software, websites, mobile applications and related services.

Throughout these Terms:

• Platform means Elimu Fiti School Management System.
• User means any person accessing the platform.
• School means a registered educational institution.
• Administrator means the authorized school representative.
• Teacher means an approved member of staff.
• Parent means a guardian linked to a learner.
• Student means a learner registered within the system.
• Subscription means any paid service offered by Elimu Fiti.

By accessing or using Elimu Fiti, you acknowledge that you have read, understood and agreed to comply with these Terms and Conditions.

Continued use of the platform after changes have been published shall constitute acceptance of the revised Terms.

The platform is intended for:

• Registered Schools
• School Administrators
• Teachers
• Parents
• Students
• Authorized Education Officials

School registration must be completed by a person who is at least eighteen (18) years of age and authorized to act on behalf of the institution.

Users agree to provide accurate, complete and current information during registration.

Elimu Fiti reserves the right to verify institutional details before activating an account.

Providing false information, impersonation, or creating duplicate accounts may result in immediate suspension.

Every user shall:

• Keep login credentials confidential.
• Maintain accurate school records.
• Protect student information.
• Use the platform responsibly.
• Report suspected security incidents immediately.
• Comply with all applicable laws.
• Avoid sharing accounts with unauthorized persons.

Elimu Fiti is designed to provide reliable and continuous access to schools, teachers, students and parents. We strive to maintain high system availability throughout the year.

However, access to the platform may occasionally be interrupted due to:

• Scheduled maintenance.
• Software upgrades.
• Internet service provider outages.
• Power interruptions.
• Cyber security incidents.
• Natural disasters.
• Government restrictions.

Where reasonably possible, users shall be notified before any planned maintenance.

Elimu Fiti does not guarantee uninterrupted service twenty-four (24) hours a day but shall make every reasonable effort to restore services promptly.

Certain modules of Elimu Fiti require an active subscription.

Subscription fees shall be communicated before activation and may include monthly, quarterly or annual billing plans.

Schools are responsible for ensuring payments are made before the subscription expiry date.

Payment Policy

• Subscriptions are payable in advance.
• Invoices become due immediately unless otherwise agreed.
• Failure to renew may result in temporary suspension of premium services.
• Outstanding balances may attract service restrictions.
• Prices may change upon prior notice.

Refund Policy

Unless otherwise required by law, subscription payments are generally non-refundable once services have been activated.

Refund requests shall be reviewed individually by Elimu Fiti Management.

Protecting user information is one of our highest priorities.

Elimu Fiti processes personal information in accordance with the Data Protection Act, 2019 of Kenya and other applicable laws.

Information collected may include:

• School information.
• Student records.
• Parent information.
• Teacher records.
• Financial information.
• Attendance data.
• Academic performance.

Your information shall only be used for providing educational services, system improvement, customer support and legal compliance.

Elimu Fiti does not sell personal information to third parties.

All student records, examination results, financial records, attendance records, inventories, payroll information and uploaded documents remain the exclusive property of the respective school.

Elimu Fiti only stores and processes such information for purposes of delivering the requested services.

Schools may request export of their information where technically possible.

Upon lawful termination of services, schools may request deletion of their information subject to applicable legal obligations.

All intellectual property rights relating to Elimu Fiti remain the exclusive property of Elimu Fiti.

This includes but is not limited to:

• Software source code.
• System design.
• Database structures.
• Reports.
• Logos.
• Graphics.
• Documentation.
• System architecture.

Users shall not:

• Copy the software.
• Modify the software.
• Reverse engineer the platform.
• Sell any portion of the system.
• Create unauthorized copies.
• Redistribute the software.

Violation of intellectual property rights may lead to legal action.

Users agree to use Elimu Fiti responsibly and lawfully.

The following activities are strictly prohibited:

• Uploading viruses or malicious software.
• Unauthorized access to accounts.
• Sharing passwords.
• Manipulating examination results.
• Creating fake students.
• Uploading offensive material.
• Attempting to hack the system.
• Sending spam messages.
• Using automated bots without permission.
• Violating copyright laws.
• Interfering with server operations.
• Using the platform for illegal activities.

Any violation may result in immediate suspension without prior notice.

Elimu Fiti promotes honesty, transparency and accountability in academic management.

Users shall not:

• Alter examination records without authorization.
• Create fraudulent report cards.
• Modify marks unlawfully.
• Delete academic records dishonestly.
• Manipulate student rankings.
• Falsify attendance records.

Schools remain responsible for ensuring that all academic information entered into the platform is accurate and verified before publication.

Any fraudulent academic activity may result in permanent suspension, legal reporting and possible prosecution under applicable laws.

Elimu Fiti reserves the right to suspend or permanently terminate any account that violates these Terms and Conditions.

Reasons for suspension may include:

• Failure to pay subscription fees.
• Unauthorized access to the platform.
• Uploading malicious software.
• Manipulation of academic records.
• False registration information.
• Misuse of school data.
• Violation of Kenyan laws.

Schools may also request closure of their accounts by contacting Elimu Fiti Support. Certain records may be retained where required by law.

Elimu Fiti performs regular system backups to help protect school information from accidental loss.

Although every effort is made to safeguard your data, users are encouraged to maintain their own copies of important reports and documents.

• Regular automated backups.
• Secure cloud infrastructure.
• Disaster recovery procedures.
• Encrypted storage where applicable.

Elimu Fiti shall not be liable for loss arising from deletion performed by authorized users or circumstances beyond our reasonable control.

Elimu Fiti is provided on an "as available" and "as is" basis.

To the maximum extent permitted by law, Elimu Fiti shall not be liable for:

• Loss of profits.
• Loss of examination opportunities.
• Internet failures.
• Power outages.
• Hardware failure.
• Loss caused by third-party services.
• Indirect or consequential damages.
• Unauthorized access resulting from poor password management.

Users remain responsible for verifying all academic, financial and administrative information before use.

Elimu Fiti shall not be held liable for failure to perform obligations resulting from events beyond our reasonable control.

These include:

• Floods.
• Earthquakes.
• Pandemics.
• Fire.
• War.
• Civil unrest.
• Government restrictions.
• Internet disruptions.
• Cyber attacks.
• Power failures.

These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of Kenya.

Any disputes arising from the use of the platform shall be resolved through negotiation where possible. Where settlement cannot be reached, disputes shall be submitted to the competent courts of Kenya.

Elimu Fiti may revise these Terms and Conditions from time to time.

Updated versions shall be published on this page together with the effective date.
